Digital License & Permitted Use

Purchasing a physical print grants you ownership of the tangible item only, not the underlying copyright. Purchasing a digital file grants you a personal, non exclusive, non transferable license to view or print the image for non commercial personal use. You may not resell, license, sublicense, redistribute, upload to stock platforms, or use any imagery for commercial advertising without explicit written permission from Grant Udy Photos.

Website Scraped Content & AI Restrictions

You are strictly prohibited from using automated scrapers, web crawlers, data mining tools, or AI models to harvest, download, or index any visual content from Grant Udy Photos. Screen grabbing high resolution previews or removing visible/invisible watermarks is a direct breach of these Terms.

Orders, Pricing, and Errors

We reserve the right to refuse or cancel any order placed on the website. In the event a product is listed at an incorrect price due to a system or typographical error, we reserve the right to cancel the order and issue a full refund, even if the order was confirmed and paid.

Accepted Payment Methods

We accept a variety of payment methods to make purchasing physical prints and digital downloads secure and convenient. All orders must be paid in full prior to order fulfilment or digital file delivery.

  • Credit & Debit Cards: We accept major credit and debit cards, including Visa, Mastercard, and American Express. Card payments are encrypted and processed securely via our payment gateways.

  • Squarespace Payments: Online credit card transactions are processed through Squarespace Payments. By paying with a credit or debit card, you agree to Squarespace Payments Terms of Service. We do not collect, process, or store your full credit card number or CVV on our servers.

  • Apple Pay: Customers checking out on compatible Apple devices can pay using Apple Pay. Transactions are authorised using your device's biometric security (Face ID / Touch ID) and are governed by Apple Pay’s Terms of Service.

  • We accept Google Pay for fast and secure checkout on supported browsers and mobile devices. When you select Google Pay, your payment is processed via our primary payment processor (Stripe) using encrypted tokenisation. Refunds for purchases made through Google Pay are credited back to the original card associated with your Google Pay account. Transactions made via Google Pay are subject to your existing agreement with Google Pay’s Terms of Service.

  • PayPal: If you select PayPal at checkout, you will be redirected to complete your payment through your PayPal account. Your transaction is subject to PayPal’s User Agreement.

Afterpay Payments

We offer Afterpay as an interest free Buy Now, Pay Later payment option for eligible orders.

  • Independent Contract: By selecting Afterpay at checkout, you acknowledge that you are entering into a separate, legally binding contract with Afterpay (operated by Clearpay/Block, Inc.). Your relationship regarding payments, installments, interest, late fees, and credit limits is governed strictly by Afterpay’s Terms of Service.

  • Approval & Eligibility: All Afterpay transactions are subject to Afterpay’s independent approval process. Grant Udy Photos has no control over, nor liability for, any decision by Afterpay to decline or limit your transaction.

  • Refunds on Afterpay Orders: If you are eligible for a refund under our Return Policy or the New Zealand Consumer Guarantees Act, the refund will be processed directly back through Afterpay. Afterpay will adjust your payment schedule or refund any completed installments to your original card in accordance with their processing timelines. Refunds will not be issued as cash or direct bank transfers.

Klarna Payments

We offer Klarna as a flexible payment option at checkout for physical print purchases. Klarna is unavailable for digital download orders.

  • Independent Agreement: When you choose Klarna, you enter into a direct agreement with Klarna Bank AB (publ). Your installment schedule, credit checks, late fees, and eligibility are governed exclusively by Klarna's Terms & Conditions.

  • Approval & Assessment: All Klarna transactions are subject to Klarna’s automated underwriting and approval criteria. Grant Udy Photos has no involvement in or control over whether Klarna accepts or declines your payment application.

  • Refund Handling: Refunds for eligible returned physical prints purchased via Klarna will be processed through Klarna. Klarna will adjust your balance, cancel future payments, or refund completed installments back to your payment card. Cash or direct bank refunds are not available for Klarna orders.

Limitation of Liability

If you are in New Zealand and a consumer of products or services, you may have certain rights and/or remedies under the New Zealand Consumer Guarantees Act 1993. When a guarantee under the Consumer Guarantees Act 1993 is breached, you may be entitled to a range of remedies. For the avoidance of doubt, nothing in these Terms is intended to exclude, restrict or modify a consumer’s rights under the New Zealand Consumer Guarantees Act 1993. To the maximum extent permitted by law (including the New Zealand Consumer Guarantees Act 1993 where applicable), Grant Udy Photos shall not be liable for any indirect, incidental, or consequential damages arising out of your use of this website or purchased products. Our total liability for any claim shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

Your use of our Site and these Terms are governed by the laws of New Zealand. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts operating in New Zealand.

Our Site may be accessed throughout New Zealand and overseas. We make no representation that our Site complies with the laws (including intellectual property laws) of any country outside New Zealand. If you access our Site from outside New Zealand, you do so at your own risk and are responsible for complying with the laws of the jurisdiction where you access our Site.
